TERMS OF WEBSITE, ONLINE COURSES, MEMBERSHIP, AND REFERRAL PARTNERSHIP

These terms of use ("Terms") apply to the website www.yogatravelrepeat.com and its subscription-based services (referred to as "Website", "Platform or "Yoga Travel Repeat"), which are owned and operated by Sini Hietaharju, Y4582883D ("Company"). By accessing or using the Website, you agree to comply with and be bound by these Terms.

2. Registration

Registration is not required to access public sections of the Website. However, to use the online store, membership, and online course services, registration is necessary. Users can register during the purchase process, creating a personal user account. A user account is also created for free trial participants. Through this account, users can manage their orders and products.

Upon registration, users receive a username and password, which are personal and must be kept confidential. If a user suspects that their credentials have been compromised, they must immediately change their password or notify Yoga Travel Repeat. Yoga Travel Repeatreserves the right to close user accounts to prevent misuse.

Users are responsible for all activities performed through their accounts and must not use their accounts in ways that damage the Website, violate intellectual property rights, or breach applicable laws. Yoga Travel Repeat is not liable for unauthorized or improper use of usernames or passwords.

Users can delete their accounts by emailing info@sinimalism.com. Account deletion is effective once Yoga Travel Repeat confirms receipt and verifies that the account can be deleted, considering any outstanding payments or legal obligations.

3. Use of the Website

Users are responsible for proper use of the Website, adhering to these Terms, applicable laws, and good practice. Users must not:

Post or distribute illegal, harmful, or defamatory content.

Hack or distribute malicious software.

Infringe on Sinimalism's intellectual property rights.

Use the Website in violation of these Terms, laws, or regulations.

Harass, impersonate, or stalk others.

Use others' usernames or passwords.

Distribute files with viruses or corrupt data.

Reverse engineer or download unauthorized software components.

Yoga Travel Repeat may block access or delete accounts if users violate these Terms or engage in prohibited activities. Users must report any billing errors due to software issues that allow unpaid access to services.

4. User-Generated Content

By contributing content to the Website, users grant Yoga Travel Repeat a non-exclusive, free, and irrevocable right to use such content for any purpose. If content includes personal data, it will be used according to Sinimalism's privacy policy. Users assure that their content does not violate laws or third-party intellectual property rights and agree to defend Yoga Travel Repeat against related claims at their expense.

5. Intellectual Property Rights

Yoga Travel Repeat owns the intellectual property rights to the Website's materials, including course content, membership content, lessons, videos, and training materials ("Material"). Users are granted a non-exclusive, limited right to use the Material for personal, non-commercial purposes only. Users retain rights to their own content but grant Yoga Travel Repeat the usage rights described in section 4.

These Terms are governed by Spanish law, excluding its conflict of law provisions. Any disputes arising from these Terms or the use of the Website shall be resolved in accordance with Spanish law.

Yoga Travel Repeat reserves the right to update these Terms at any time. Updated Terms will be posted on the Website, and continued use of the Website constitutes acceptance of the changes. The last update was on 28.05.2024.

10. Money-Back Guarantee

If users do not benefit from the course after practicing the exercises for at least three months, they are entitled to a full refund. Refund requests must be submitted to info@yogatravelrepeat.com after 90 days of purchase, explaining the situation. Refunds will be processed within 30 days if the course is deemed ineffective. Please note the money-back guarantee is only valid on courses where it is mentioned when purchasing the product.

GENERAL TERMS OF USE OF THE SITE

1. General

These General Terms and Conditions ("General Terms") apply when customers make purchases on Sini Hietaharju's ("Yoga on Repeat") online services (www.yogatravelrepeat.com) (collectively referred to as "Website", "Yoga Travel Repeat" or "Yoga on Repeat Membership"). The processing of personal data on our Website is governed by our Privacy Policy, available here. Additionally, the Terms of Online Courses and Memberships apply to any online courses and memberships purchased through the Website.

Yoga Travel Repeat is not responsible for sold-out products displayed on the Website, image or printing errors, or errors in price information. Yoga Travel Repeat may offer, mediate, or market paid or free services or products produced by third-party service providers. Such third-party services are provided as-is without warranty, and Sinimalism is not liable for any damage caused by errors, delays, or unavailability of third-party services. Customers must comply with any special contract terms, liability limitations, and instructions of third-party service providers.

The Website and its content are the property of Yoga Travel Repeator third parties and are protected by intellectual property rights. Copying or using the content without Yoga Travel Repeat's written consent is prohibited.

Customers must accept these General Terms to place an order through the Website. By accepting these Terms, customers agree to comply with them and confirm they have read and understood them, as well as the Privacy Policy. A contract between the customer and Sinimalism is formed when the customer places an order and Sinimalism confirms it by sending an order confirmation via email.

2. Prices and Payment Methods

The prices of goods and services on the Website are determined by the current price list, displayed on the Website and in the item or service descriptions. All prices include VAT but do not include payment method or transportation costs, which are shown separately before order confirmation. Yoga Travel Repeat reserves the right to change the price list at any time.

Customers can pay using the payment methods accepted by Yoga Travel Repeat, handled in cooperation with Stripe. Stripe processes payments, and payment information is not stored in Yoga Travel Repeat's systems. More details on Stripe's privacy policy can be found here. Sinimalism appears as the payee on account statements and invoices, and Stripe forwards payments to Yoga Travel Repeat. Payment is secure, with all transaction information transmitted via an encrypted connection.

3. Delivery of Goods and Services

Services are delivered as quickly as possible, usually immediately after successful payment. Goods are typically delivered within 30 days of order. Yoga Travel Repeat may use third parties for purchases, with their purchase and delivery conditions applying.

Risk of loss or damage transfers to the customer upon handover. If a transport company is used, risk transfers when the goods are handed over to the transport company. Ownership remains with Yoga Travel Repeat or its partners until full payment is received.

4. Right of Cancellation

For digital services, the consumer does not have a 14-day exchange and return right as per the Finnish Consumer Protection Act because digital products can be used immediately. The right to cancel within 14 days applies unless the delivery of the digital product has begun. By accepting these Terms, customers agree that the right to cancel is waived upon commencement of digital product delivery. If you do not accept these conditions, do not proceed with the purchase.

5. Force Majeure

Yoga Travel Repeat is not liable for delays or damages caused by force majeure events, including general industrial actions, acts of war, natural disasters, epidemics, government restrictions, or telecommunication issues.

6. Transfer of Agreement

Users cannot transfer their rights and obligations related to the purchased coaching service to third parties.

7. Applicable Law and Dispute Resolution
